SCOTUS Limits Nationwide Injunctions in Birthright Citizenship Case
Ruling against nationwide injunction threatens both immigrant families and the foundation of our democratic values.
NASHVILLE–Today the Tennessee Immigrant and Refugee Rights Coalition (TIRRC), the largest member-based immigrant rights organization in Tennessee, reacted to today's disastrous ruling by the Supreme Court of the United States in the ongoing case against the Trump administration's attempt to limit birthright citizenship.
The ruling does not address the lawfulness of the president’s Executive Order attempting to limit birthright citizenship, which every lower court to address the issue has held to be unconstitutional. Instead, the decision grants a partial stay of the nationwide injunctions to the extent they are broader than necessary to provide complete relief to the plaintiffs in the case CASA v Trump, leaving that determination to the district courts. This means the current injunction only bars the enforcement of the Executive Order for the plaintiffs in this case: the individual plaintiffs, and members of the organizations Asylum Seeker Advocacy Project (ASAP) and the immigrant rights organization CASA.

"Today's ruling is devastating for growing immigrant families, as it allows a fractured, patchwork implementation of the Trump administration's outrageous plan to deny birthright citizenship to children born in the US, an act that defies the US Constitution, over 150 years of precedent, and the very values that this country was founded upon.
Possibly more frightening is what this ruling says about the state of the judiciary and our democracy, as it undermines the judiciary's role of providing checks and balances on the executive branch. As the current administration continues to ignore due process, defy court orders, and railroad constitutional rights, it's the power of the judiciary that protects the rights of the people against such tyranny.
But make no mistake, Trump's attempt to end birthright citizenship is unconstitutional, as every lower court to hear the issue has demonstrated. We stand behind these brave plaintiffs who are standing up to protect not only their families, but the rights of all who call our country home.”
